How to get H1B visa in US embassy in Canada?

I arrived to USA with J1 visa in my passport. Since that time I applied / and received F1 status and now I have H1B status (not a visa in my passport). I still have 1.5 year before H1B will expire.





This is my question: I want to visit my home country and in order to come back here - I will need to go to US embassy there with my H1B documents and ask them for "real" visa to put in my passport. I heard it much more risky to do there comparing with Canada (where people in us embassy should be much friendly).


Please give me any advice on this. Maybe someone had same situation as I?


All what I know is:


1. I have to send my documents to US embassy there in Canada


2. They will give me temporary visa to Canada, just to get to embassy for interview? Or interview is not needed?


3. I show them my documents, proof of employment e.t.c. (IT Specialist)


4. If everything is well - I will get my visa and can visit home and come back - if not - I will be asked to leave to Europe right away.

How to get H1B visa in US embassy in Canada?
If you intend to return home anyway, you need to apply for your H1b visa there. I can't say if you would need a visa for Canada or not since you haven't mentioned what country you are from. And, it's impossible to say how long you would need to be in Canada to process your visa application, but you will certainly be interviewed, there or anywhere else you apply. One, you would need to get an interview appointment. If you're from a country that requires special clearances, they won't give you an appointment date unless you are a resident in Canada, because there's no way to know in advance how long that will take. If any problem does pop up on your application, you could be stuck there for a while. If you have to be stuck somewhere, it's probably better and cheaper for you to be stuck at home. You should have whatever evidence of your changes in status, while you were in the US, and the I-797 approval notice of your H1b petition. Plus, evidence of your employment and pay while working for your current employer.
